Booking Fees and Session Fees
For all regular sessions a 50% non-refundable booking fee is required to book and hold the date for your session and serves as a cancellation fee. The remaining balance is due before the date of session. The booking fee must be paid via check, PayPal, or cash. Your date will not be reserved until your booking fee has been received and your check has cleared (if paying by check). Any bounced checks will be charged an additional fee of $25.
For weddings, a 50% non-refundable booking fee is due at the time of booking. However, I understand that is a lot of money to pay at once, so you have the option to split that into 2 payments (25% due at booking and 25% due at least 6 months before the wedding).

Rescheduling/Canceling
If for any reason, a client does not show up or decides to completely cancel their session, their booking fee will be forfeited.
If an illness or family situation prevents a photo session from taking place, the client may reschedule their session at least 48 hours prior to their session without penalty.
Limited Edition/Mini Sessions: Due to their nature, limited edition, mini, and themed sessions are 100% non-refundable. The booking fee is due at the time of booking and the remaining balance will be due within 48 hours of your session. If you need to cancel for any reason, any monies paid will be forfeited. You are welcome to send a replacement in the event that you cannot make your allotted time.
Weddings: Due to the nature of wedding photography, all booking fees are non-refundable if the wedding should be canceled for any reason. If the wedding date is moved, the deposits are transferable as long as there is a 3 month notice and the date doesn't conflict with another wedding or large event.

- If the client fails to give 48 hours notice and would like to reschedule, 50% of their fees paid will be forfeited and will not apply as a credit to any remaining/future fees or balances. - If a client chooses to reschedule their session when temperatures are average for that time of year, their original booking fee will be forfeited and the process will restart.

Timeliness
Client agrees and understands that the start time agreed upon is the time the session begins. If the client is late for any reason, the time will be deducted from their session. If client is more than 15 minutes late (for a 30 minute session) or 30 minutes late (for a 60 minute session), Fogle Point Photography has the right to leave and the booking fee will not be refunded or moved to another date. If client would like to reschedule after photographer has left, an additional booking retainer fee is owed.
In the unlikely event that Fogle Point Photography is late for any reason, the time she is late will be added to the session. If client decides to leave after 15 minutes (for a 30 minute session) or 30 minutes (for a 60 minute session), Fogle Point Photography will either refund the booking fee or move the date without an additional booking fee being necessary.
Exclusivity
FPP shall be the exclusive photographer retained by the client for the purpose of photographing the wedding, event, birth, or regular session. Client agrees that no other photographer shall be hired to photograph during the time frame in which FPP is retained. Photographer shall have the exclusive right to enlist and direct the services of assistance and/or sub-contractors. Additionally, guests shall be permitted to photograph the wedding at the photographer's discretion (unless not allowed by the client for an "unplugged event"). Guests may not photograph poses arranged by the photographer or interfere with the photographer's ability to capture the event. FPP reserves the right to ask guests to step aside in the event that they are interfering.
Edits
Fogle Point Photography reserves the right to edit and release only the images that are deemed creditable as professional in quality and within Fogle Point Photography’s standards. The photographer enhances photos via corrections to contrast, lighting, and color, as well and removal of baby acne, rashes, and accidental last minute scratches, bumps, etc. FPP does not change any inherent qualities of a person, as it is considered a "cosmetic edit" and will charge $10 per photo if requested by the client after seeing the edited proofs. Cosmetic edits include, but are not limited to: removing unwanted facial hair, wrinkles, adding hair to balding head, changing hair color, etc. It is requested the client take care of all cosmetic changes before the shoot if they do not wish to have gray hair, facial hair, etc in final photos.
Edits are solely made by FPP, any edits by clients or family members to digital files will void this contract, close the gallery, and may be punishable by law as it is a violation of copyright.

Refund Policy
The Client(s) hereby agrees that he/she fully understands that there are no refunds or exchanges on purchases due to the custom nature of ‘for hire’ photography.
Copyright & Licensing
The images that are being provided to you are licensed to you for any reason personal, including: printing, emailing, and social media. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.
Your purchase of the original files releases FPP from any liability due to loss or damage of the images, and also releases FPP from any obligation to maintain copies of any digital file, image, or photograph over 6 months old. Failure to download your gallery within 7 days may result in a $25 archival fee to re-upload your gallery for download.
All photographs will remain the property of Fogle Point Photography and FPP reserves the right to use and publish images and photographs taken at your photography session to further promote its service. FPP agrees to limit the use of these images and photographs to promotional use only.

Cooperation Clause
Photographer reserves the right to cease coverage without prior notice, and with no retaliation, and no refund given, in the event that any guest, vendor, employee or otherwise present individual attempts to physically, verbally, or sexually harass or assault the photographer or any other member of the photographer's team. The photographer will report any illegal activities witnessed to law enforcement. Clients and/or their guests are not to touch any photography equipment or play with props beyond photographers permission due to cost of said equipment & any damage done by client and/or their guest will be responsibility of the clients to pay for any such damages
